Nothing to see here, just a fastidiously maintained, US (and California!) legal, british racing green over full brown leather and green carpet !!!error: Indecipherable SUB-paragraph formatting!!! that’s one of 20 “Elekta” special editions originally sold in Italy.

These pictures show the color rather darkly but if you go to the video at the bottom the green is much more apparent.

I figured with the modern-classic BMW market on the rise that it was actually a fair price. If I were absurdly wealthy I might pay it, but not if I just had the budget for one $60,000 car.

“US (and California!) legal”

This is a 1995. To qualify, the car must have been originally sold in the US, and the engine and emissions equipment must be approved by the EPA. The ad says the car has been “federalized” meaning it has been brought into compliance with EPA and DOT regulations, but clearly if the ad states the car is producing 340hp that is not the case, as BMW never had the EPA evaluate this engine because it (S38B38) was never sold here. So at the least it would need the same emissions equipment as required by the S38B36 engine. Also consider that the S38 was not sold in the US after 1993 so the EPA would need to grant an exemption. NHTSA states the 1995 5-Series is eligible for importation, but not the M5. The speedometer being in KM instead of miles also shows that the car was not federalized, and FMVSS requires OBD-II diagnostics for 1995 vehicles as well, which this is lacking if it has the S38B38. Someone is going to be very upset when this gets crushed.

I don’t know the details but the listing says,

“Documentation also includes ownership history from three collector caretakers, the second of whom imported the car to California in 2005 before it moved on to its current owner, a longstanding BMWCCA member, in 2015. Factory build sheets are included as well as a copy of BMW Car Magazine containing a feature on the car. Federal and California compliance paperwork is also included, and the car last passed a California emissions check in November 2015.”

Somehow it’s been registered and passing emissions in California for 12 years.

I do know that FMVSS requires OBD-II for 1996 , not 1995, as there are plenty of 1995 model cars that were sold in the US without OBD-II.

Although this sticker, upon closer inspection, says 3.6L motor, not 3.8L, so there may be some fudging going on.

But again, the feds don’t care what California says. It was imported in 2005, so it’s been here illegally and un-federalized for over a decade. The speedo and engine are proof.

Not saying it’s legit, but this G&K Automotive Conversion does in fact have a website . Their yelp reviews aren’t exactly promising.

Who knows? It’d be a (potentially costly) adventure!

That’s a pretty awesome sticker to have on it. First-blush I would have second guessed it except for the engine and speedo. I wonder if they have the EPA sticker/paperwork for it.
